Terms and Conditions for the Use of the Resus Time Mobile Application
§ 1 Definitions
- APPLICATION (or "Resus Time") - a mobile application
called Resus Time, developed and provided by the Association, designed
to be downloaded and installed on Android or iOS mobile devices. The
application is an educational tool that aims to support the learning
of medical students and improve the professional skills of paramedics,
physicians, and nurses in cardiopulmonary resuscitation.
- ASSOCIATION - Stowarzyszenie Forum Intensywnej
Terapii, which is the owner and administrator of the Application, with
its registered office at ul. św. Tomasza 22/14, 31-027 Kraków, Poland,
entered in the Register of Associations of the National Court Register
under the KRS number: 0000892140.
- USER - an individual practising or studying a medical
profession who uses the Application.
- TERMS AND CONDITIONS - these regulations for the use
of the Application.
- CONTENT - all information, data, instructions,
functionalities, and other elements made available within the
Application.
§ 2 Purpose and Scope of Use of the Application

The Resus Time application is a tool for educational and training
purposes only and is helps learn the principles of cardiopulmonary
resuscitation (CPR), as well as document CPR exercises and training.
It is not intended to be used in actual medical activities or to make
decisions regarding human health or life.

In particular, the Application allows the User to:

use a timer with three loops (CPR, adrenaline, and
defibrillation),
- use alarms and a metronome,
- record the rhythm and medications administered,
- record events and take notes,
- use a checklist,
- review CPR algorithms,
- generate a simulation report.

The information presented in the Application is for support and
information purposes only and is intended for those studying or
practising a medical profession.

The Resus Time application does not constitute a medical device within
the meaning of Regulation (EU) 2017/745 of the European Parliament and
of the Council of 5 April 2017 on medical devices (MDR).

The Application does not allow the User to make purchases or process
payments within it.
§ 3 Limitations of Liability

The Association shall exercise due diligence to ensure that the
Content presented in the Application is correct, reliable, and in
accordance with current medical knowledge.

The use of the Application does not relieve the User of the obligation
to independently evaluate the clinical situation presented in the
simulation and make decisions in accordance with current medical
knowledge, applicable standards, and laws.

The Association and those acting on its behalf shall not be liable for
any clinical decisions, actions, or omissions made on the basis of
information presented in the Application.

The Application is for educational purposes only, does not exhaust the
subject matter it covers, and is not intended for diagnostic or
therapeutic use.

Despite the exercise of due diligence, disruptions, errors, or
interruptions in the operation of the Application may occur. The
Association shall not be liable for the consequences of such events
unless they are due to wilful misconduct or gross negligence.

In the event of disruption, the Association will immediately take
appropriate technical and organizational measures to restore the
proper functioning of the Application.
§ 4 Rights and Obligations of the User

The User agrees to use the Application only for its intended purpose,
in a manner consistent with applicable law, morality, and these Terms
and Conditions.

The Application may only be used by persons who are at least 16 years
old. The installation and use of the Application by younger persons
requires the consent of a parent or legal guardian.

The User is entitled to use the Application and Content for
self-study, teaching, or training purposes, including workshops,
practical classes, and medical simulations.
-
It is permissible to use the Application for training, courses, and
educational classes organised by universities, medical entities, or
other institutions conducting teaching activities, as long as this is
done without modifying the Application and maintaining its
non-commercial nature.

The User may not rent, sell, sublicense, lend, or otherwise make the
Application or its elements available to third parties for a fee.
§ 5 Data in the Application

Data stored in the Application is collected and processed only locally
in the memory of the User's device.

The User shall be considered the controller of any data they enter
into the Application.

The Association and those acting on its behalf do not provide the data
entered by the User to third parties, as they do not have access to
it.

Detailed rules regarding the processing of personal data in connection
with the use of the Application are set forth in the Privacy Policy.
§ 6 Updates and Changes

The Association reserves the right to make changes and updates to the
Application, including its functionality, security features, and
compliance with applicable laws, and to amend these Terms and
Conditions.

The Users will be informed of changes to the Terms and Conditions in
advance.

The amended Terms and Conditions are effective as of the date of their
publication (November 1, 2025) and are accepted by the continued use
of the Application after the effective date of the amendments.
§ 7 Intellectual Property

Copyrights and intellectual property rights to the Application, its
functional elements, and Content - both as a whole and in individual
parts - are vested in the Association or other authorized third
parties and are subject to protection under copyright and other
applicable laws.

The application constitutes a work under copyright law. The User is
not authorized to copy, modify, translate, adapt, decompile,
disassemble, decode, or attempt to determine the source code thereof,
except as expressly permitted by law.

Upon downloading the Application, the User is granted a non-exclusive,
non-transferable, non-assignable, and non-sublicensable license, valid
throughout the world, entitling the User to use the Application in
accordance with its intended purpose and the provisions of these Terms
and Conditions, including use for teaching or training purposes,
provided that the User maintains its non-commercial nature.

Apple Inc. and Google LLC are not a party to this license agreement
and are not responsible for the Application, its operation, or
technical support. Any questions or tickets should be sent directly to

§ 8 Governing Law and Jurisdiction

Agreements concluded under these Terms and Conditions shall be
governed by the laws of the Republic of Poland.

Matters not covered by these Terms and Conditions shall be governed by
generally applicable provisions of Polish law, in particular the Civil
Code and the Act of 18 July 2002 on the provision of services by
electronic means.

Any disputes arising in connection with the use of the Application
shall be subject to the jurisdiction of the common courts having
jurisdiction over the registered office of the Association.
§ 9 Technical Requirements

For the use of the Application to be possible and correct, the User's
device should meet the following minimum technical requirements for
mobile devices (iOS/Android):
- iOS: an iPhone running iOS 13.4 or later,

Android: a device running Android 6.0 (API level 23) or later,
- RAM: at least 2 GB (4 GB recommended),
- free device memory: about 50-100 MB,
- processor: compatible with ARM64 or x86_64 architecture.

Some features of the Application may require additional permissions or
device capabilities:

audio: audio playback support (for alarms and the metronome),
-
screen standby: the Application can prevent the screen from
automatically blanking during a session.

Internet connection:
-
is not required for the basic functions of the Application (timer,
CPR algorithms, checklist, logging of sessions),
-
is only required for the contact form function in the "About
application" section.

Additional technical information:
- the Application supports dark and light modes,
- available interface languages: Polish, English, Ukrainian,
- screen orientation: portrait,
-
the Application uses the device's native features, including
system sounds.

The Association is not responsible for the malfunction of the
Application if the above technical requirements are not met.

In the event of any disruptions, the Association shall promptly
undertake appropriate technical and organizational measures aimed at
restoring the proper functioning of the Application.
§ 10 Issue Reporting and Technical Support

The User may submit comments, questions, or technical problems
regarding the operation of the Application to info@resustime.com or
via the contact form.

The Association will endeavour to respond to the submission within a
reasonable period of time, not to exceed 14 days.
-
Submissions do not constitute complaints or claims under the Polish
Consumer Rights Act, as the Application is provided free of charge and
is educational in nature.
§ 11 Final Provisions

If any of the provisions of the Terms and Conditions are declared
invalid or ineffective, the remaining provisions shall remain in
force.

The use of the Application by the User implies their acceptance of
these Terms and Conditions. If the User does not accept the Terms and
Conditions, they should stop using the Application.

The User may stop using the Application at any time by removing it
from their device.

These Terms and Conditions are effective as of the date of their
publication on App Store and Google Play.
